2. USERS

Access and/or use of this portal of Valencia in English, creator of the website, attributes the condition of USER, who accepts, from said access and/or use, the General Conditions of Use listed here. The aforementioned Conditions will apply regardless of the General Conditions of Contracting that, in their case, are mandatory.

3. USE OF THE PORTAL

Valencia in English provides access to a multitude of information, services, programs, or data (hereinafter, “the contents”) on the Internet belonging to Valencia in English , creator of the website, or its licensors to which the USER may have access. The USER assumes responsibility for the use of the portal. This responsibility extends to the registration that may be necessary to access certain services or contents.

In said registration, the USER will be responsible for providing truthful and lawful information. As a consequence of this registration, the USER may be provided with a password for which they will be responsible, committing to make diligent and confidential use of it. The USER undertakes to make appropriate use of the contents and services (such as chat services, discussion forums, or newsgroups) that Valencia in English offers through its portal and, including but not limited to, not to use them to (i) engage in illicit or illegal activities or those contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, illegal-pornographic nature, in apology of terrorism or against human rights; (iii) cause damage to the physical and logical systems of Valencia in English , its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are capable of causing the aforementioned damages on the network; (iv) attempt to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages.

Valencia in English reserves the right to withdraw all comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that attempt against youth or childhood, order or public security or that, in its opinion, are not suitable for publication. In any case, Valencia in English will not be responsible for the opinions expressed by users through forums, chats, or other participation tools.

The data controller complies with the provisions of Regulation (EU) 2016/679, of April 27 (GDPR), and Organic Law 3/2018, of December 5 (LOPDGDD), guaranteeing the correct use and processing of the users’ personal data.

The USER undertakes to respect the Intellectual and Industrial Property rights owned by Valencia in English. Valencia in English will pursue the breach of these conditions as well as any improper use of its portal exercising all civil and criminal actions that may correspond in law.

Valencia in English may modify at any time the conditions determined here, being duly published as they appear here. The validity of the aforementioned conditions will depend on their exposure and will remain in force until they are modified by others duly published.

12. APPLICABLE LAW AND JURISDICTION

The relationship between Valencia in English and the USER will be governed by current Spanish regulations and any controversy will be submitted to the Courts and Tribunals of the city of Valencia.
